Kindle Scout - The Contract

Happy Tuesday, everyone! I know I missed my post yesterday. Don't judge. *sticks out tongue* But, I promise to more than make up for it today. How? Well, I'm gonna break down the Kindle Scout contract for you all. I have no pony in this show, so this is literally going to be a breakdown of legalese (I provided links to sources). Well informed is always the way to be! Okay, grab a cup of coffee because this post is gonna be long. Let's get going!

*****DISCLAIMER: I AM NOT AN ATTORNEY! AS ALWAYS, IF YOU HAVE A QUESTION ABOUT ANYTHING YOU'RE SIGNING, CONSULT A LICENSED LAWYER*****

This is a layman interpretation of the contract.

First off, you can find the agreement here.

Go read it before you begin.

Now, this contract (because that's what it is and why you have to be 18+) has two parts: Submission and Publishing Terms. I'll break it down by section. Items in bold are ones to pay close attention to (I'll explain at the end). Remember, everything in the Publishing Terms section goes into effect the day your work is selected. Any time referenced is measured by that date.

Let's start with Submission.

1 - ELIGIBILITY - ACCOUNT

• 1.1 - This is all about saying you're 18 or up, have all copyrights, and are able to enter into a legally binding contract.
• 1.2 - You have an Amazon account and are yourself (not using someone else's ID).

2 - SUBMISSION AND REVIEW - Your materials will be referred to as "Submission Materials" this term includes: Manuscript, Cover Art, Your Name, Bio, and anything else you submit. It can't have been for sale previously. They can reject you for no reason.
3 - EXCLUSIVITY PERIOD - They own all of the above for no less than 45 days. If you're selected, the second part of the contract becomes effective immediately (no signing required) upon notification.
4 - YOUR SUBMISSION - Your work is theirs to do with as they please concerning sharing (not changes). You may offer excerpts for free on blogs and such, but can't sell any part of your work. If you want your work removed after (and weren't chosen), you must submit the request in writing.

Now, on to Publishing Terms.

5 - RIGHTS - All of the company and their affiliates have rights to your work that you can't break out of (that's what irrevocable means). They may shorten the work, edit the work, or add your work to a collection of other works at their choosing. This does not (according to section 7, allow them to perform edits without your permission).
6 - REVERSION - (broken down into 6 sections)

• 6.1 - These terms auto-renew every five years (from selection date) that you don't make at least 25k (that's at least 5k per year). You can request your rights back in writing if you don't make that amount.
• 6.2 - You may request, in writing, to get your rights back under the following circumstances:
• 6.2.1 - Your work was not made available for sale within six months.
• 6.2.2 - If you don't make at least $500 in the second 12 months of the first two years.
• 6.2.3 - If the audio version hasn't been made available within 2 years.
• 6.2.4 - If the work isn't available in a specific language (outlined in the contract), you can have the rights to the work in that language back (remember, this must be done in writing).
• 6.3 - Any reversion (getting your book back) will depend on who else has rights (they get to keep those rights if the agreement was made before you get your book back). All shares those entities were entitled to stay in place. If you get your book back via one of the stipulations above, you get to keep your advance ($1500 is paid to you when you're selected).

7 -  PUBLICATION - You have 30 days to make revisions. If you don't turn in revisions, they have the right to use the original submission. They won't make material changes without your permission.
8 - ADVANCE, PRICING, ROYALTIES, PAYMENT

• 8.1 - Your $1500 advance is paid within 30 days of the date they get your final work and payee info, and is considered a royalty payout. This means the first $1500 your book makes goes back to the publisher.
• 8.2 - They set the price of the work, and own all customer data.
• 8.3 - They'll pay you royalties as follows (Net Revenue means how much they actually make from each sale and does not include promotional copies, samples, or excerpts, and subtracts delivery costs, returns, and taxes):

EBook = 50% of net revenue

Audio = 25% of net revenue

Translated EBook = 20% of net revenue

• 8.4 - 75% of net revenue on sub-licensed translated versions (less above subtractions and fees), 50% of all other sub-licensed sales.
• 8.5 - You'll get a monthly sales report. Payouts are 60 days past the end of the month. If it's a third-party sale, you get the payout 60 days after they receive payment.
• 8.6 - They can withhold payment of royalties, offset against future royalties, or require you to pay them back money (as described below). This does not limit the ways in which they're allowed to withhold payment.
• 8.6.1 - If there are returns after a payment is made, they can withhold payment in the future or require you to pay them back.
• 8.6.2 - If a third party claims you violated rights by claiming part of your work, they have the right to not pay you anything further and can make you repay them.
• 8.7 - You're responsible for your taxes. They'll pay theirs and will provide you with any documentation you may need to pay yours.

9 - COPYRIGHT, RIGHTS PROTECTION - You appoint them as your attorney-in-fact to file copyright claims with the government. They have the right to take someone to court, and you agree to help them (at their expense).
10 - PROMOTION - They get to determine how to promote your work. You may use 10% of the work to promote yourself on blogs or websites, but can't use their name unless it's on the cover.
11 - REPRESENTATIONS AND WARRANTIES - You agree that the work is original and you have the right to sign it all over. You agree there is no libel (harmful statements about anyone), and your work doesn't break any kind of laws. You've never sold the work before, and anything you say is true, is. Your work won't bring harm to the user.
12 - YOUR INDEMNITIES - You agree not to sue them for any perceived loss. They can sue you for not upholding the agreement.
13 - NO OBLIGATION TO MAKE OR SELL - TERMINATION BY THEM - They don't have to sell your work and have the right to stop doing so at any time without telling you. They can cancel the contract with written (e-mail is fine) notification if you breach your contract per item 11 or if you fail to uphold your end of the agreement.
14 - LIMITATION OF LIABILITY - They aren't responsible for losses, damages, or theft, in any way (verbatim: WE SPECIFICALLY DISCLAIM). All they're responsible for are your payments.
15 - EXECUTION OF FURTHER AGREEMENTS AND DOCUMENTS - They may need physically signed documents from you. If you don't provide them within 30 days per their instructions, you give them the right to sign for you and it's all legally binding.
16 - DISPUTES - You agree not to go to court if you have any kind of dispute. You'll use binding arbitration instead (definition: a neutral third party makes the final decision - reference here). You must follow directions listed in this section to make a claim. You agree not to join a class-action (more than one person) suit. You may take them to court over infringement claims, and they may do the same to you.
17 - APPLICABLE LAW - This is all legal according to this law: Federal Arbitration Act (Wiki link).
18 - GENERAL PROVISIONS

• 18.1 - All notices must be given in writing. Effective date is sent date or postmarked date (this includes a provision for e-mails).
• 18.2 - This agreement comes before any other agreements made.
• 18.3 - No modifications may be made unless done in writing and agreed to by everyone.
• 18.4 - This agreement doesn't mean you're partners or are in a joint venture. You can't transfer it, and neither can they. It's enforceable by your successors or assignees.
• 18.5 - If either party doesn't enforce part of the agreement, it doesn't mean they can't at a later date. If any ruling in court says any part of the agreement can't be enforced, it doesn't have any effect on the rest of the agreement. You won't assume things because they're the ones that wrote the agreement.
• 18.6 - The following sections will survive the termination of the agreement (those are the ones in bold): Sections 4, 8, 11, 12, 13, 14, 15, 16, 17, and 18.

So, now you can make a decision.

Again, if you have any questions, I urge you to print out the agreement and take it to an attorney for further clarification. It's pretty straightforward, in my opinion.

I love contracts. I think they exist to protect both parties. If you're working with someone who doesn't require one, you need to be asking why.

Mystic~Melody Official Release Day

Synopsis:

When Melody sees magazines laden with beautiful girls, she begins to look at herself in the mirror and think she should look more like them. Her mind takes the cruel letters to a dark place and she stops eating altogether. Before long, she's in the clutches of death.

By the time Markaza, a mystic with purple hair and tattoos, shows up, Melody's on her last legs. It's either eat or die. Markaza works furiously to try and repair the mental damage done so she can get Melody to New York; where she must learn to use a power hidden deep within herself to save the world.

They're running out of time. As December 21, 2012 approaches at an alarming rate, Markaza's visions turn dark and foreboding. The creature grows stronger every day. Soon it will rise and destroy mankind unless all six women band together to fight it.

Melody must be saved or the world will be destroyed.

Markaza leaned forward and put a hand on Melody’s knee. “I’m sorry that happened. I can only imagine how crushed you must’ve been.”

“It was horrible. The look in her eyes scared me more than anything. I still don’t know why that watch shattered.”

“To teach her a lesson.” Markaza’s voice took on a vicious edge. “Tell me about the letter.”

Melody chewed her lip. “What letter?”

“Don’t play dumb. The one you mentioned earlier.”

They locked eyes, and Melody felt like the information was being pulled right out. With a shaky hand, she reached into her back pocket and produced the worn paper. As she passed it over, she realized she must’ve folded it back up and replaced it after her run automatically. She shook her head.

As Markaza read the words on the page, her face contorted and her nostrils flared. When she slapped it down on her knee and curled her fingers into claws, Melody thought the girl was about to punch something.

“Who sent this to you?”

“I don’t know. It isn’t signed and the envelope didn’t have a return address.”

Markaza’s eyes roamed up and down Melody’s body. “Is this the reason you’ve done that to yourself?”

Saying nothing, Melody turned her head and peered out the window. She felt her stomach tighten so hard it made her toes curl.

They rode the rest of the way in silence.

When they arrived, Melody ushered her new friend straight upstairs from the foyer. There was no way Mom could find out the girl was there. Mom would flip out, and there was no telling what Markaza would do; she looked dangerous.

Melody pushed through the door, closed it, and turned the lock. She figured she was eighteen and there was no reason she couldn’t lock her door. Besides, if all went well, she’d be gone soon anyway. No locked doors was a bullshit rule.

Markaza was standing stock-still, staring at something.

“What?” Melody asked.

“You have a poster of Lily Conyers on your wall.” Markaza gestured to the huge ad taking up half the wall by the bed.

“Yeah? So?”

“She works for WSTW now.”

Melody’s mouth dropped open and she squealed. “Really? Do you think I could meet her if I go to work for them? I just love her! She’s sooooo beautiful!”

“You know what? I think that’s a pretty good idea. But you’re gonna have to work really hard to get well if you ever want to meet Lily. She’s pretty popular, you know.” Markaza was grinning, but it didn’t look like a happy smile.

Wolfish was the only word Melody could think of to describe it. A shiver ran up her spine. “So, umm, what do I need to take with me?”

“Just what matters most; things that can’t be replaced at a store. Don’t worry about a lot of clothes or shoes,” Markaza answered.

Melody opened a small suitcase on the bed and began throwing things into it. Most of what she decided to take had sentimental value rather than monetary: an old pocket-sized photo album, some jewelry she’d gotten as gifts from special people, a few outfits, and two pair of shoes.

A shaking of the door handle followed by a knock reverberated through the room, and Melody froze mid-stride.

“Melody? You better unlock this damned door right now!” Debra’s voice floated through the room, and her daughter moved toward the door as though pulled by some invisible force.

Markaza stepped forward and blocked the path. “Tell her you’ll be down in a minute.”

“I can’t. She’ll be so pissed!” Melody whispered. After a moment of silence, she relented. “I’ll be down in a minute, Mom.”

“No. You’ll open the door this very instant!”

Heat filled Melody’s body as her voice rose. “No! I’m not a baby. You’re done treating me like one! I said I’ll be down in a minute, and that’s what I mean.” She was trembling from head to toe; but, somehow, Markaza’s presence was providing strength.

“I’m calling your father!”

Melody groaned and put her head in her hands. “Now I’ve done it.”

Markaza grabbed the girl’s trembling arms. “Stop it. She won’t hurt you with me here. Get your stuff and let’s go.”

The Help - What a wonderful read! I picked it up after I saw the movie because I was super curious about the book behind the plot. Book wins; hands down!

First Visions Second Sight Book One and New Revelations Second Sight Book Two - About a psychic who denies her powers until she's needed to help find a missing girl. There are two in the series so far and both were fantastic reads! Guess what? They're both FREE today! Book One and Book Two! Go get yours!

Dragon's Mind - Wow. My first real trip into science fiction! I loved this book. It's about a girl and a brain trying to escape the clutches of an evil organization.

Paid Reviews and Polls

I've been hearing a lot about paid reviews. I've also been doing some thinking. Questions have risen in my head and I'm looking for public/author feedback here.

I understand that buying a review raises some eyebrows. However, what if those weren't all 5star or 4star reviews? What if the reviewer uses a specific scale, rates the book on specific things, and gives a little detail on each?

For Example:

• Story/plot (1 star)
• Grammar use - not a ton of typos (1 star)
• Well defined characters (1 star)
• A command of the language (1 star)
• Transitions/flow (1 star)

Would you then look for that company or reviewer's posts on books before you bought them? Would their voice mean more or would you still assume they were rating unfairly because money changed hands?

Let's be real for a moment. Indie authors give away hundreds of thousands of books every day with no guarantee of a review. There are many that might pay for reviews if they didn't feel like they were selling their soul to the devil. Let's face it, the guarantee of a 5star review is appealing, but who does that help? Honest reviews will sell more books, right?

I know not everyone can afford to buy a review. But we all know that reviews count in algorithms and that we're desperate for them as indies. They can make us or break us.

What if the company or reviewers publish every review, no matter the star rating, even if they were paid to review the work? Would you be less skeptical of the review once it was written and more apt to seek out that company or reviewer's reviews before making a purchase?

Synopsis:
Abigale Fontenot is turning thirteen. Just when she thinks her birthday couldn't possibly get any worse, a new adventure takes hold. Abigale and Emmett are whisked away to a world of fantasy where knights, dragons, and princesses are the order of the day. Abigale is kidnapped by an evil prince in a nearby kingdom, and it's up to Emmett to rescue her. But Abigale finds that escape is not the most important thing; restoring the evil prince's kindness that has been locked away in a magical book by a wicked sorceress must come first. While Emmett is trying to rescue Abigale, she is trying to free the prince from his curse. Will she succeed in her quest before the evil prince kills Emmett, or will she fail and lose her new best friend? Will death matter if the whole thing is a dream, or are the adventures real and truly dangerous?

Flashbacks

Perhaps this should be titled Flashbacks, Flashforwards, and Flashing in General? Today, good people of the blogosphere, we will be discussing memories, dreams, and thoughts. Read on and enjoy!

There are a ton of ways to do a flashback when writing a novel. But you don't want to take your reader out of the tale and inundate them with backstory. You'll find they skip over those parts; that's bad. So let's discuss ways to make your flashbacks and such important as well as give a few ideas on how to work them in.

Leading up to the flashback, there should be some reason it's about to occur. This could be the character standing immobilized with fear or could be that he/she sees something that sparks a memory. It's the words leading up to the flashback, dream, or inner-dialogue that will keep your reader engaged.

Explain, don't tell. Flashbacks, dreams, or inner-dialogue could go in italics to remind your reader that they're in the head of the character. Some people prefer to put an extra space before and after and just leave them in regular type. I, personally, prefer both reading and writing these scenes in italics. But there must be good transition in order to keep my attention.

I'll use examples from a couple of my books.

In Yassa, when young Genghis Khan has a dream, they are almost always telling the future and are usually terrifying. So, instead of writing that he fell asleep and is about to have a dream about it, I write that his head hit the pillow and he was seized by the terror of a nightmare. Then the dream sequence begins and I put it all in italics. To make it relevant, later on I tell that happenings occur just as they did in his dream. Those dreams are never boring and always leave my hero either with residual feelings or a call to action when he wakes up. This is what I call a flashforward. Unless you're writing about someone who is clairvoyant (as Genghis believed he was), this won't work.

I do the same with Markaza in Mystic.

I don't use it at all in The Abigale Chronicles series for two reasons: 1. I begin book one at the beginning of all the craziness and 2. I don't want the reader to know if Abigale is dreaming or not - the mystery is half the fun!!

Inner-dialogue also goes into italics in my books; just to let the reader know this isn't something that's being said, rather something that's being thought.

Flashbacks work the same way. If you're going to give a flashback, the reader should understand why, who it's about, and what time period it takes place in.

A good example would be if a character is remembering something traumatic from childhood. This memory could be sparked by him/her smelling a rose and having a flashback of a friend who died and had roses on their coffin that smelled the same way. This character may close their eyes and remember every detail of that funeral (including at what time it took place) but it should be no more than a few paragraphs and there should be an emotional reaction in the present that justifies the memory's significance. Perhaps the rose they smell is then ripped to shreds and the character cries for their loss while babbling about it to a stranger. It must be relevant in that it shapes an action or explains something about the character's behavior in the here and now.

Flashbacks should be short and are different from a step-back through time which can be whole chapters with no need for italics.

Inner-dialogue should be treated the same way. If the character is thinking something, don't pull the reader out of the here and now to deliver it. Work it in with the current happenings.

I hope this helps explain a few things about flashbacks, dreams, and thoughts.

On a totally unrelated note, my daughter used a word incorrectly yesterday that made me correct her a couple of times. She used the word ideal instead of idea when she was talking about a thought a character in a book we were reading had. Granted she's only six, but better to squash that word butchering out of her now. It's difficult being my kid!!

Pesky Pronouns

Today I'm gonna talk about her. You know, she, him, it. Let's get to it.

A pronoun is a reference to the last person named in the text. If you use the word she after saying Abigale's mother, or her mother, whatever you put after the word she is referencing, not Abigale, but her mother.

Examples:

Abigale flew into her mother's arms and buried her head in the crook of her arm. This is incorrect. Even though it may sound okay in your head, it's wrong.

What you're saying is Abigale flew into her mother's arms and buried her mother's head in the crook of her mother's arm.

What you wanted to say is (and you have to reword or it sounds ridiculous): Louise's arms caught Abigale as she flew into them and buried her head. This is correct.

Now, if you have Abigale and Emmett both in the sentence, it's okay to use he and she because we know who the last gender named was.

Abigale and Emmett were walking through the woods at a good pace when she suddenly stopped and turned to him. She said, "Emmett, stop stepping on my shoes!" This is correct.

Let's throw another boy into the mix now.

Abigale, Emmett, and Mark were walking through the woods at a good pace when she suddenly stopped and turned to him. She said, "Emmett, stop stepping on my shoes!" This is incorrect. If she wanted to speak to Emmett, he either should have been listed last or the pronoun should have been them.

Am I confusing you yet? I thought I might be.

I have a simple trick to examine a sentence (you will thank me someday, I hope):

Wherever he, she, it, them, they, her, his, their, its, etc... appears, go back through the sentence and replace the pronoun with the name of the last person named. If it still reads the way you meant for it to, you are correct. If it doesn't, some rewording is in order.

If I used it on the example above with the three children, it would read like this:

Abigale, Emmett, and Mark were walking through the woods at a good pace when Abigale suddenly stopped and turned to Mark. Abigale said, "Emmett, stop stepping on my shoes!"

It reads wrong. She should be turning to Emmett. See how easy that was to find?

Now, there are times I misplace my pronouns (it's SOOOO easy to do!) but I thought I'd share a little bit of info and maybe a tip to help you in your personal editing journey. Many times, you'll find you have to reword a whole sentence to make it work with your pronouns. But take the time to do that. You won't be sorry.
